Texting
You could fall into a pool of crap if you're not paying attention while texting. Ol' BC will venture a guess that some attorney will take this case. It looks like the preoccupied texter is laying the groundwork. Contributory negligence? We'll have to wait on the lawsuit to see.
Just an observation.

The stupidity of the bimbo texting while not seated in a safe place, out of harm's way is almost balanced by the stupidity of the work crew not protecting an open manhole. I call it a push.
Unfortunately, city governments are seen as having an unlimited supply of free money, so the bimbo will probably be awarded millions.
For the benefit of your non-judgemental readers, I'll apologize and retract calling the stupid girl a bimbo. Calling her a bimbo is too kind. She's actually a twit.
I guess I should clarify a bit. I'm a construction inspector and, though it's ingrained in me that contractors MUST erect barricades around an open manhole, or any other hazard. The contractor (or city agency) that left the manhole open will be liable and will have to pay damages.
That said, the twit should've been paying attention to her surroundings. One can be absolutely legally correct, and can still be dead.
